DEFINITIONS

The term Subscriber would include any person, whether an individual or a legal entity who has subscribed to the Services of www.aveguru.com (whether on a paid or free basis), and to whom the access to www.aveguru.com is restricted by the use of a sign in user name and a password. All attempts shall be made by AVE and the user to abide by International Best Practices in containing and eliminating Spam.
• Gaining unauthorized access to other computer systems.
• Interfering with any other person's use or enjoyment of the Website.
• Breaching any applicable laws.
• Interfering or disrupting networks or websites connected to the Website.

Violations of system or network security may result in civil or criminal liability.

RESTRICTIONS ON FULFILLMENT OF REQUESTS ON WWW.AVEGURU.COM

www.aveguru.com reserves the right, at our sole discretion, to limit the fulfillment of requests placed on this Website. These restrictions may be applicable to request placed by the same person or account, the same credit / debit card /net-banking account, and also to requests that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. www.aveguru.com also reserves the right, at our sole discretion, to prohibit fulfillment of requests to any one as it may deem fit. NON-GUARANTEE OF EXACTNESS www.aveguru.com hereby disclaims any guarantees of exactness of the Services published on the Website to that of the Services as actually requested and availed by the user. FINANCIAL DETAILS You agree, understand and confirm that the credit / debit card / net-banking account details or other financial details provided by you for availing of Services on www.aveguru.com will be correct and accurate and you shall not use the credit / debit card / net-banking account or financial facility which is not lawfully owned / obtained by you. You also understand that any financial information submitted by you is directly received by our acquiring bank and not stored by www.aveguru.com. www.aveguru.com will not be liable for any credit / debit card / net-banking account fraud. The liability for use of a credit / debit card / net-banking account fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you. All information collected by us shall be governed as per our Privacy Policy. PAYMENT TERMS Payments for the Services offered by www.aveguru.com shall be on a 100% advance basis. The payment for Services once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated. Refund if any will be at the sole discretion of AVE. AVE offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the users credit / debit card / net-banking accounts. User acknowledges and agrees that AVE/www.aveguru.com, at its sole discretion and without prejudice to other rights and remedies that it may have under the applicable laws, shall be entitled to set off the amount paid or payable by a subscriber/user against any amount(s) payable by user to AVE under any other agreement or commercial relationship towards other services. AVE gives no guarantees of server uptime or applications working properly. All is on a best effort basis and liability is limited to refund of amount only. credit / debit card / net-banking account undertakes no liability for free Services. credit / debit card / net-banking account reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them. AVE uses the maximum care as is possible to ensure that all or any data / information in respect of electronic transfer of money does not fall in the wrong hands. For completing online transactions involving payments a user is directed to a Payment Gateway. Since the transaction happens on a third-party network not controlled by AVE, once a credit / debit card / net-banking transaction has been completed, the payment information is not accessible to anyone at AVE. This ensures the maximum security. AVE shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit / debit card / net-banking accounts and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise. Refund in failed transactions Though AVE payment reconciliation team works on a 24 x 7 basis, AVE offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Subscribers credit / debit card / net-banking accounts. This is on account of the multiplicity of organizations involved in processing of online transactions, the problems with Internet infrastructure currently available and working days/holidays of financial institutions. Refunds in the event of wrong/objectionable content being posted on the Website would be at the discretion of www.aveguru.com.

ELECTRONIC COMMUNICATIONS

When you visit the Website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

SUBMISSION AND ADMINISTRATION OF LISTINGS/ADVERTISEMENTS

Corporate Property Services (Real Estate) Property Listings/Advertisements Any User agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each property's data to www.aveguru.com unless the User submitting such Listing(s)/Advertisement(s) has acquired received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) on the User's website or on www.aveguru.com. Similarly, www.aveguru.com doesn’t take any ownership, directly or indirectly towards any person whatsoever, with respect to Listing(s)/Advertisement(s) (including images and banners) hosted on its website by its users, which are strictly in the nature of sale of space by www.aveguru.com and it has not carried out any independent verification on the authenticity or compliance requirements, as may have been required under any law for the time being in force, of such Listing(s)/Advertisement(s) (including images and banners). In case a User is covered under any of the applicable laws or Acts etc. it shall have to ensure adherence of all compliance necessary, including but not limited to obtaining the necessary registrations etc. The User shall disclose all material information in respect of their registrations and compliances under any of the applicable laws or Acts and all such property(s) submitted including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not. The User in addition shall furnish a brief background of such property in respect of title, ownership and possession, AVE may also require the User to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time. The User may further be required to substantiate his claims as to the nature and status of the property by swearing an affidavit stating the authenticity of the information/data so provided/displayed. AVE may, at its sole discretion but without any obligation to, search for such and remove Listing(s)/Advertisement(s) that are alleged to have been submitted in violation of this provision. In addition, AVE may require additional evidence of compliance with this provision from Users who are alleged to have submitted properties or other information/data in violation of these terms and conditions. AVE will, in its sole discretion, terminate the accounts of, and refuse Service to, any User who repeatedly or intentionally violates these terms and conditions. Additionally, the User agrees to allow the Listing(s)/Advertisement(s), or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the User's website or the www.aveguru.com website. AVE shall have the sole authority to choose the manner in which any Listing(s)/Advertisement(s) will be searched, displayed, accessed, downloaded, copied, and otherwise used on www.aveguru.com and AVE shall have the right to modify the Listing(s)/Advertisement(s) in the exercise of its rights under these terms and conditions. In addition to the terms aforementioned the User agrees: (a) to represent and warrant that all Properties and associated information provided by the User in its Listing(s)/Advertisement(s) will be accurate (b) that the User will not permit the posting of a property in its Listing(s)/Advertisement(s) on www.aveguru.com under a name other than the name of the legal owner or power-of-attorney holder or of a real estate agent who has been duly authorized and engaged by the legal owner/ power-of-attorney holder of the property in this regard AVE shall place the information relating to Listing(s)/Advertisement(s) at defined sections of www.aveguru.com or such other mirror or parallel site(s). AVE reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Listing(s)/Advertisement(s) posted on the User's website or on www.aveguru.com without notice. AVE accepts no responsibility for checking/verifying the accuracy of reports or data files submitted by the User. While AVE shall take all reasonable efforts for data backup and business resumption, the User will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to www.aveguru.com. Users, who are leasing/buying property/properties through www.aveguru.com, must verify details of the property/properties as well as its right, title, ownership, lien etc. on their own. Other Listings/Advertisements Other business verticals of AVE which include Turnkey Interiors & Projects, Start-up Mentoring, Funding, Insurance shall also require users to submit descriptions, photographs, financial, contact or other information as required and Users agree that they shall be doing so at their own risk and responsibility. www.aveguru.com doesn’t take any ownership, directly or indirectly towards any person whatsoever, with respect to Listing(s)/Advertisement(s) (including images and banners) hosted on its website by its users, which are in the nature of sale of space by www.aveguru.com and it has not carried out any independent verification on the authenticity or compliance requirements, as may have been required under any law for the time being in force, of such Listing(s)/Advertisement(s) (including images and banners). In case a User is covered under any of the applicable laws or Acts etc. it shall have to ensure adherence of all compliance necessary, including but not limited to obtaining the necessary registrations etc. The User shall disclose all material information in respect of their registrations and compliances under any of the applicable laws or Acts. AVE shall have the right to modify the Listing(s)/Advertisement(s) in the exercise of its rights under these terms and conditions. In addition to the terms aforementioned the User agrees to represent and warrant that all information provided by the User will be accurate. AVE shall place the information relating to the Listing(s)/Advertisement(s) at defined sections of www.aveguru.com or such other mirror or parallel site(s). AVE reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Listing(s)/Advertisement(s) posted on the User's website or on www.aveguru.com without notice. AVE accepts no responsibility for checking/verifying the accuracy of reports or data files submitted by the User. While AVE shall take all reasonable efforts for data backup and business resumption, the User will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to www.aveguru.com. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying.
